His comrade was killed and Files had to recover the body. His barrister, Tabitha Buck, said he suffered hearing loss after being attacked on one tour and while on another was ambushed. In mitigation, the court heard the defendant had a difficult childhood and served as a kingsman in the Army where he completed two tours - one in Iraq and another in Afghanistan. He fractured his fibula and also suffered ligament damage. The prosecutor said while being arrested there was a struggle and the weight of the defenedant caused the officer to fall. Mr Dryden said: "He was heard to say 'get off me now you're taking me nowhere' and 'I'll f***ing assault you." The incident was captured on body worn footage and shows the defendant being aggressive towards police. Mr Dryden said police searched the home and found the defendant hiding in a wardrobe. The defendant was staying with the woman and when police tried to gain entry to the property she was uncooperative. At around 3.30am, on June 22, officers attended Glebe Road in Darlington after reports of a disturbance. Teesside Crown Court heard while on bail for the offences, the defendant injured a police officer. The victim was able to call Durham Police and he was arrested. "The defendant grabbed her around the neck with both hands and again strangled her so she was unable to breath." He became abusive and was calling her a s*** and threatened to kill her and her parents. Mr Dryden said: "There was a further argument, the defendant was told to leave. Mr Dryden said the woman returned to her Darlington home but received numerous calls from the ex-soldier who then turned up at the address at around 4am. Around two months later, on September 9, Files and the woman had been out for a meal when the pair began arguing again. The court heard the victim messaged her father and the police were called. She was then punched in the face and thrown across the room." The defendant threatened to hang her out of the bedroom window. "The defendant then released his grip and she was able to scream for help before she was strangled again. The defendant grabbed her and put both hands around her neck and strangled her for about five or six seconds. The prosecutor said: "The defendant perceived he was being ignored by and became argumentative. Outlining the case, prosecutor Shaun Dryden said the defendant had been in a relationship with the woman for around six months when he strangled her. The 34-year-old left the Darlington victim with bruising to her body and face following the assault.
